How Do I Respond to a Summons and Complaints for a Credit Card Debt in WA?

I owe a huge amount of money on 2 credit cards, I defaulted, received the ‘validation of debt’ documents. I confirmed that I owed the debt, and I just received the summons and complaints. I cannot pay the required amount, and I do not have the funds to hire a lawyer. However, I do want to respond to the summons and complaint, and also work out an arrangement. What is my best course of action.
I was told – since I have enough equity in my home – that the lawyers representing the credit card company can put a lien on my house, and force foreclosure. Is that common, and what can I do to avoid this?

It is hard to say what action they might take against you since you only defined the defaulted amount of money as a huge amount. If they are taking you to court over it my guess is it is indeed a substantial sum, but without knowing how much I do not know what they would do for sure so I can only offer up some guesses. One is that they would indeed place a lien on your home. Im not sure what state you reside in so your states laws may differ from others as far as what they can actually do with a lien though. Honestly I have never herd or anyone being forced into foreclosure because a lien was placed on the property. A lean means that in the event the house is sold any equity or proceeds from the sale must first go to the lien holder and or holders. Foreclose is usually the result of the bank when you fail to meet the obligations of your mortgage such as falling behind on payments. They may take some other property such as cars, and or garnish your wages. If you truly can not afford to pay them back there is a chance a judgment may be issued against you, but they may not be able to collect until they verify you are getting more income. Which means that you would just have a judgment against you. This as im sure you are already aware will all but destroy your credit.

2. Documented proof of your current income. If you have a job, this will mean getting pay stubs. If you have incoming coming in from other sources, you will have to provide proof of that as well. I had child support and maintenance payments that I had to provide proof of. Sending them copies of checks worked in my case.

3. Tax returns for the past few years. My mortgage company required the past 3 years of tax returns. If you file a 1040, just to be on the safe side, I would provide them with any schedules (A, B, etc) and any additional forms as well as the 1040 form itself.

4. Hardship letter. Here is where you explain what your financial hardship is. Here is where you get to make your case. Explain that you want to stop house foreclosure and what your situation is. Some things that many mortgage companies will accept as financial hardship is divorce, job loss or disability.

Every mortgage company has different requirements and in order to stop house foreclosure, you will need to get the requirements from your bank.

A helpful tip: Fax or email all of the paperwork that they want all at once. They are busy and it is very likely that your information could get lost or misplaced if you fax or email your paperwork in separate batches to them. Also always reference your loan number on everything that you send to them.
